Correct, but a defendant is not required required to measure with legal nicety the amount of force necessary to effect the self defence. If the store clerk could establish [1] that he was still subjectively scared (this is very easy, just say "I was scared"), and [2] that there was still an objective threat (this would be harder but not impossible. The robber could have said something like "I am going to get up and stab you."]

He got what he deserved. He attempted to rob the place, and trashed it while doing so. The clerk beat him down and then kicked him a few times, certainly well within the law and the rights of self defense, since he had no way of knowing if the man would suddenly spring up and attack.

This was never self-defense. One, the only danger is the danger he put himself in by initiating physical contact when he came in with the flying crane kick. He could have stayed locked in a safe room while waiting for the cops. Two, self defense is the force necessary to protect yourself and no more. He pretty much overstepped his bounds when he kept kicking him when he was down. Nobody is much of a threat when they're down on the ground covering their face. If he did have a gun down his pants wouldn't he have shown it by now? Sadly, the store guy would probably get convicted of assault in most courts-of-law. But it was nice to see the robber get his ass beat.
In the good ol' US of A, they have the right to bear arms, even on the streets to defend against would be robbers and usually 9 times out of 10, some fool ends up being shot. One reason I would never go there.....

Mark - Actually we aren't relaxed on gun laws. We have over 12,000 federal, state, and local laws in the US dealing specifically with firearms. However, explain to me how more laws apply to criminals? They just have more to break. They don't follow those laws - by definition. More gun laws only restricts the rights of people who legally use them for defense. Criminals don't care - I know, I work with 1,400 of them every day in the prison.
More gun laws aren't the answer. We can't get rid of all the guns... the cats out of the bag. All it would do is create yet ANOTHER black market, and thus create more crime. Law abiding people don't go out and commit crime, again, by definition.
The guy did deserve it, 100%. But I HAVE a feeling the clerk went a bit over his legal boundaries. He probably didn't get prosecuted in criminal court though. The robber might have pressed charges though. Which were probably dropped. Maybe a civil suit. I had an inmate try to sue me for using offensive language - about a minute AFTER he cussed me out. It was pretty sweet to see the clerk drag the guy by his hair though.
ALSO, I forgot. 9 times out of 10 people don't end up getting shot. The US Department of Justice did a study by compiling all the police reports in a given year that dealt with armed self defense, and the numbers added up to 97 percent of the time a shot was NOT fired. So I would say it's close to 3 out of 100 times someone ends up getting shot. There is also an interesting study (by a credible Law Enforcement Source) that says you are 20% more likely to die from a knife wound than a gunshot wound... but I won't go into that here.

This does NOT mean I take the Prosecutors side in this, but just how I KNOW this would unfold, if this kid died, just from having seen it so many damn times. In this scenario, the conviction will be either 2nd degree or manslaughter or criminal negligence causing death; He WILL get time. It's panned out this way MANY, MANY times up here, as well as all over the U.S. for a LONG, LONG time. And all for what? Now, obviously the kid didn't die; but even after watching this video, I'd be TOTALLY surprised if this kids lawyer didn't take this storekeeper for everything he's got. Would I turn my back, no. In the heat of the moment, would I do the same, maybe or maybe not. How can you say you wouldn't if you are not experiencing it yourself? You don't think you would be pissed if someone was messing with your man/spouse and store? Emotions and adrenaline can take over in such situations. So I can't say how I would have handled it other than an ass whoopin in the making. At what point would I have stopped? At such a time that I felt the situation was under control. This would be extreme to some, not enough to others, and some would say just right. Everyone's opinion varies so their answers will all be different.
How was he restrained? When he was sitting on him? He didn't have him in the full guard position so his right hand wasn't inflciting much damage. Maybe he felt he wasn't doing the damage necessary to contain the situation? Maybe his right hand was hurting from punching him in the back of the head and needed to use his feet to disable the opponent. I don't know the reasoning, but would I convict him on the excessive use of force? Absolutely not. Could he have used a little less? Absolutely. I won't say he went overboard though.

I was an MP in the Marine Corps for four years, which isn't a whole lot but long enough to have my perception changed of what I used to think self defense was as a civilian to actually being taught what self-defense is according the the law. Either you get it or you don't- that guy ceased to be a threat about 10 seconds into the fight. He did nothing and made no gesture which can reasonably be percieved as threatening. Unless you count breathing and trying to cover your face as threatening. The store keeper clearly knew he would have the upper hand or he would not have come out and ninja-kicked the dude in the first place. I don't know what kind of fights you got in when you were younger, but I personally stopped fighting when the guy was on the ground covering his face and appreciated it when I was the guy on the ground covering my face and the other person understood I was no longer willing or able to fight back.
A person does not have to be knocked out to be restrained. You don't have to break his arms and gouge out his eyes cuz he can still see you and possibly strike at you. That's ridicolous. The military is not trained to shoot first and ask questions later. MP's are not the only people being taught restraint. Why does everybody recieve a rules of engagement brief before they deploy that specifically states under what circumstances you can employ force? As an MP we are taught the force ladder or escalation of force. It starts with MP presence, goes on to verbal commands, to compliant escort/ restraint, on to non-compliant restraint, O.C. spray, batons, working dogs and finally to deadly force. You use the least amount of force necessary.
Either you get it or you don't brother. Would you want a guy to kick the living shit out of you and break your arms if you looked at his girl funny? Cuz to some guys that is 100% justifiable. Laws are in place so you aren't left at the mercy of what others percieve to be fair.

I get the difference between restraint and excessive force. I think it is in the gray area. I simply would not convict him of criminal charges. Canuck and you might, but I simply wouldn't. His life was possibly threatened and he did what he felt was necessary. If he drug him off, beat him some more and then serious injuries were a result, I might change my mind. but it didn't happen, at least that we are aware of, so I will not speculate or answer the hypothetical.
It's easy to point out things when you are not in a situation. If you were in the same situation, how would you react? You can't honsetly answer this as you are not experiencing it firsthand. You can say you would have stopped after 10 seconds, when in reality you could have stomped his head into the pavement after he was unconscious. As to the actual video, I can understand how someone not trained in defensive practices might go to excess after being confronted by an aggressor. I personally don't know how to incapacitate another person...so had I been assaulted and gained the upper hand, I have no idea where "reasonable" defense begins or ends...I just would want to make sure the attacker was definitely out of action. That might mean that later, after the fact, some one might suggest less of a reaction. So be it...but at the moment of assault, I think the benefit of the doubt goes to the assaultee, not the assaulter, as to physical outcomes.
Chaz you just have us both pegged. We are egomanical that has to have the upperhand in any argument. So shut-up, watch the videos and don't read the posts, or start taking potshots at either of us.
